Terms of Service

PounceX monitors public posts on X (Twitter) for keywords and phrases that you configure, uses automated tools — including third-party data providers and AI language models — to identify potentially relevant posts, and generates draft replies for your review.

Important: PounceX does not automatically post, send, or publish anything on your behalf. Every reply generated by the Service is a draft only. You are solely responsible for reviewing, editing, approving, and manually posting (or choosing not to post) any content the Service generates, and for any consequences of doing so.

You must be at least 18 years old to use the Service.

You must provide accurate information when creating an account and keep it up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You are responsible for ensuring your own use of X (including any account you connect, reference, or post from) complies with X's own Terms of Service and policies. PounceX is an independent tool and is not affiliated with, endorsed by, or operated by X Corp.

Free trial: New accounts may receive a limited number of drafted replies as part of a free trial. The trial limit is disclosed in-app and may change at our discretion.

Subscription plans: Paid subscriptions renew automatically on a recurring basis (e.g., monthly) until cancelled. You can cancel at any time through your account billing settings; cancellation takes effect at the end of the current billing period.

Founding Member / Lifetime plans: A limited number of one-time-payment lifetime access spots may be offered. Lifetime access applies to the PounceX product as it exists and reasonably evolves over time, is non-transferable, and is subject to the same acceptable-use and termination provisions as subscription plans. Lifetime pricing and spot availability are offered at our discretion and are not guaranteed to be available at any given time.

Payment processing: All payments are processed by our third-party payment processor (currently Creem). We do not store your full payment card details. By purchasing a plan, you agree to that processor's applicable terms.

Refunds: Except where required by law, payments are non-refundable once a billing period has started or a one-time lifetime purchase has been completed. If you believe you were charged in error, contact us at support@pouncex.com and we will review it in good faith.

Price changes: We may change our pricing for future billing periods with reasonable advance notice.

You agree not to use the Service to: violate X's Terms of Service, automation rules, or any applicable law; send spam, harassing, deceptive, or misleading messages; scrape, resell, or redistribute data obtained through the Service in bulk to third parties; attempt to reverse-engineer, disrupt, or gain unauthorized access to the Service or its underlying infrastructure; use the Service to monitor or target private individuals for harassment or surveillance purposes; or impersonate another person or entity, or misrepresent your affiliation.

We may suspend or terminate accounts that violate this section, with or without notice, at our discretion.

The Service uses third-party AI models to draft reply suggestions and to score the relevance of detected posts. You acknowledge that AI-generated drafts may be inaccurate, incomplete, off-tone, or unsuitable, and must be reviewed by a human before use.

Relevance scoring and tiering ("HOT," "WARM," "RESEARCH," or similar) is a best-effort estimate, not a guarantee of buying intent or lead quality.

PounceX does not guarantee any specific outcome, including but not limited to sales, revenue, conversions, replies, or business growth. The Service is designed to help you find and respond to publicly available opportunities more efficiently — actual results depend on factors outside our control, including market conditions, your offer, your pricing, and the actions of other users and third parties.

Because signals are drawn from public data on X, other users of the Service (or of other tools) may see and respond to the same public posts. PounceX does not offer exclusive ownership of any lead, tweet, or opportunity unless explicitly stated in a specific plan's terms.

The Service relies on third-party providers, including but not limited to data/search providers, AI model providers, authentication and database infrastructure, and payment processors. We are not responsible for outages, data inaccuracies, or policy changes originating from these third parties, though we will make reasonable efforts to maintain service continuity.

PounceX and its original content, features, branding, and functionality are owned by us and protected by applicable intellectual property laws. You retain ownership of the product/business information you input and of any reply content you choose to edit and post. You grant us a limited license to process that information solely to provide and improve the Service.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, PounceX and its founders, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service shall not exceed the amount you paid us in the 3 months preceding the claim.

You may stop using the Service and cancel your account at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, fail to pay applicable fees, or if required by law. Upon termination, your right to use the Service ends immediately; certain provisions (including the AI-Generated Content, Disclaimer of Warranties, Limitation of Liability, and Governing Law sections) survive termination.

These Terms shall be governed by the laws applicable in the jurisdiction in which PounceX operates, without regard to conflict-of-law principles, except where mandatory local consumer protection law provides otherwise. Any dispute arising out of these Terms will first be attempted to be resolved informally by contacting us at support@pouncex.com.

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (e.g., via email or an in-app notice) before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
